1. Introduction
These terms of sale apply to the sale of goods from www.bigfunhobby.com to consumers. Consumer purchases over the internet are regulated by, among other things the Contracts Act, the Consumer Purchases Act, the Cancellation Act, the Marketing Act and the E-Commerce Act. These laws give you as a customer inalienable rights. See www.lovdata.no for more information.
The terms and conditions of sale are in line with the recommendations of the Norwegian Consumer Authority.
2. The agreement
The agreement consists of these terms and conditions of sale, information provided in the online store at the time of purchase, and any separately agreed terms. In the event of a conflict, special agreements take precedence over the terms and conditions of sale, as long as they do not conflict with applicable legislation.
3. The parties
Seller: Topten AS, organisation number 928673987
Buyer: The person who makes the purchase in the online store.
4. Price
All prices are quoted in Norwegian kroner (NOK) and are inclusive of value added tax (VAT). The total price to be paid will be displayed before the order is finalised. There will be no hidden costs.
5. Conclusion of the agreement
The purchase agreement is binding when the order is submitted. By making a purchase, you agree to these terms of sale.
If there are obvious clerical or pricing errors, and this is or should have been obvious to the buyer, the agreement is not binding on Topten AS.
6. Payment
We offer secure payment solutions through our partners. When paying by card, the amount can be reserved at the time of ordering and deducted upon dispatch. When paying by invoice, the payment deadline is a minimum of 14 days from receipt. Invoices are not offered to persons under the age of 18.
7. Delivery
Delivery is made to the address provided by the buyer when placing the order. Goods are normally dispatched within 1-3 working days, and within 30 days at the latest. Unless otherwise agreed, the goods must be delivered without undue delay.
8. Risk to the goods
The risk for the goods passes to you as the customer when the goods are delivered in accordance with the agreement.
9. Right of cancellation
You have a 14-day right of cancellation from receipt of the goods. In order to exercise your right of cancellation, you must give clear notice by e-mail to dag@topten.no. The item must be returned no later than 14 days after notification has been given. Return shipping is covered by the buyer unless otherwise agreed.
The item must be returned in the same condition as received. You may examine the product, but if it is used beyond what is necessary to determine its properties and function, you may be liable for a reduction in value.
Refunds will be made no later than 14 days after we have received the goods or documentation for the return.
10. Delay and non-delivery
If the goods are not delivered within the agreed time, you may withhold payment, demand delivery, cancel the purchase or claim compensation in accordance with the Consumer Purchase Act. Complaints must be made within a reasonable time, preferably in writing.
11. Defects in the goods
In the event of faults or defects, you can demand rectification, replacement, price reduction, cancellation or compensation. You must notify us within a reasonable time of discovering the defect, and no later than two years after receipt (five years if the item is intended to last significantly longer).
12. Seller's rights in the event of customer default
In the event of non-payment, we may demand fulfilment, cancellation, interest and any collection fees in accordance with applicable rules. In the case of unclaimed goods, we may charge you for actual costs associated with shipping and returns.
13. Guarantee
Any warranties are in addition to your statutory rights and will not limit your claims for errors or defects.
14. Privacy policy
Topten AS processes personal data in accordance with the Privacy Act. We only store necessary information to complete the purchase. Data is not shared with third parties unless it is necessary to fulfil the agreement (e.g. shipping company).
15. Complaints and dispute resolution
